Limits on Noneconomic Damages

Limits on noneconomic damages

It is important to know about non economic damages and it is easy to understand with an example. In case of an injury during an accident, the damages caused to you will be classified into two categories as economic and non economic damages. Easily quantifiable damages such as lost wages, medical bills, the fees for a doctor, the amount for buying medicines, transportation etc are known to be economic damages.

In case another party is responsible for the accident and all the damages caused to you as a result economically reimbursement will be given for all that you have paid. On the other hand the non economic damages are the damages that can not be easily quantified. For example, let us take the suffering, the pain and the inconvenience. Generally in almost all the states there is no existence of limitations, but the trend is changing now. There are some states which have limits for the maximum amount of money that you can claim for the non economic damages In case you one of the residents of one such state then the maximum claim that you can get is the amount prescribed by the state, say 2.5 or 5 lakh dollars. Taking into account the different aspects such as the pain caused, the treatment cost, the lost wages, the suffering, any physical or mental impairment as a result of the accident an amount of compensation is given. Yet the amount given as settlement will not be exceeding the statutory money in your state, even if you think that you deserve more.
