Elements of the case

The definition of the elements of a case is as follows. The parts or components of a claim that is legal or of a cause of an action are referred to be the elements of the case. Each and every element concerned with a legal claim must be proved by a plaintiff in order to win lawsuit. The cause of an action can be defined as follows. A legal claim that is specific- for example any breaching of contract, negligence or a medical malpractice for the purpose of which a plaintiff asks for and seeks compensation. Discrete elements form together a cause of action and it is important that all of them are proved in order to win a case. In order to know what elements of a case are, take the following example. For example consider the claim for breach of contract.

The first element is that there had been valid contract. The second is that the plaintiff has been performing as mentioned in the contract. It was the defendant (defendant is that person against whom a lawsuit has been filed. The fourth is that an economic loss was suffered by the plaintiff due to the breach of contract by the defendant. In case of a medical malpractice the four elements would as following. The first element- the doctor owed some duty to the patient. Second element- the doctor was somehow instrumental in the breach of contract. Third element is that there has been an injury to the patient. The fourth is that there must be proof for the damages caused. So these are the elements of such a case.
